Samuel Madeleine Shipping Policy

This Shipping Policy applies to purchases from Samuel Madeleine / Stradmelle, LLC (“Samuel Madeleine,” “we,” “us,” or “our”) through https://samuelmadeleine.com, Shopify checkout, quotes, invoices, purchase orders, or any other approved sales channel.

By placing an order, approving a quote or invoice, making payment, or instructing us to proceed, you agree to this Shipping Policy and our Terms of Service & Full Terms of Sale.

Shipping Overview

Samuel Madeleine products are commonly made-to-order, special-order, imported, vendor-direct, limited-availability, vintage, antique, one-of-a-kind, or otherwise specially procured. Shipping methods, freight costs, delivery options, and timelines may vary by product, vendor, origin, destination, size, weight, fragility, site conditions, and carrier availability.

Shipping, freight, delivery, white-glove delivery, insurance, tariffs, duties, customs charges, brokerage fees, import fees, storage, and related charges are the customer’s responsibility unless Samuel Madeleine expressly states otherwise in writing.

Lead Times And Delivery Estimates

Lead times, production dates, shipment dates, delivery dates, arrival dates, and service dates are estimates only and are not guaranteed unless Samuel Madeleine expressly states otherwise in writing.

Delays may occur due to manufacturers, artisans, suppliers, production schedules, product availability, material shortages, customs, tariffs, duties, port congestion, weather, carriers, freight capacity, labor shortages, building access, third-party providers, site readiness, payment issues, missing information, force majeure events, or other circumstances outside Samuel Madeleine’s control.

Samuel Madeleine is not liable for delay-related damages, lost use, lost profits, business interruption, project delays, missed events, reputational harm, replacement costs, or consequential damages.

Third-Party Carriers And Delivery Providers

Shipping and delivery are performed by third-party carriers, freight companies, delivery providers, couriers, installers, contractors, warehouses, or other independent providers unless Samuel Madeleine expressly states otherwise in writing.

Samuel Madeleine may help coordinate shipping or delivery, provide tracking information where available, communicate with carriers, or assist with claims, but third-party carriers and delivery providers are independent businesses responsible for their own handling, timing, labor, equipment, methods, insurance, and performance.

Samuel Madeleine is not responsible for damage, loss, delay, misdelivery, missed delivery appointments, storage charges, carrier handling issues, or other shipping problems caused by third-party carriers or delivery providers.

When a third-party shipping issue occurs, Samuel Madeleine will make reasonable efforts to assist the customer with documentation, communication, and carrier claim coordination. Carrier claim approval, denial, timing, investigation, and remedy are controlled by the carrier, insurer, freight company, delivery provider, vendor, or manufacturer and are not guaranteed by Samuel Madeleine.

Title And Risk Of Loss

Title to products passes to Customer upon full payment.

Unless otherwise required by law or expressly agreed in writing, risk of loss transfers to Customer when products are tendered to the carrier, freight company, delivery provider, third-party provider, Customer, Customer’s representative, receiving location, loading dock, warehouse, storage location, or delivery site.

Shipping Charges

Shipping and delivery charges may be calculated at checkout, quoted separately, invoiced separately, or collected after an order is placed depending on product size, destination, freight requirements, vendor terms, and delivery method.

Shipping and delivery charges are estimates unless Samuel Madeleine expressly states otherwise in writing. Additional charges may apply for remote locations, limited access, residential delivery, liftgate service, inside delivery, white-glove delivery, storage, redelivery, missed appointments, refused delivery, special handling, insurance, customs, tariffs, duties, brokerage, building requirements, or other carrier-imposed fees.

International, Tariff, Duty, And Customs Charges

Prices do not include tariffs, duties, customs charges, brokerage fees, import fees, VAT, port fees, storage fees, government charges, or similar charges unless expressly stated.

Customer is responsible for all applicable tariffs, duties, customs charges, brokerage fees, import fees, taxes, and government charges. These charges may be estimated at the time of quote or invoice and may change based on government action, supplier classification, product origin, carrier charges, customs processing, or other factors.

Shipping delays related to customs, tariffs, duties, inspections, port congestion, or government action are outside Samuel Madeleine’s control.

Delivery Address And Customer Information

Customer is responsible for providing current, complete, and accurate shipping information, receiving information, contact details, delivery restrictions, building rules, access details, and any requirements needed for delivery.

Samuel Madeleine is not responsible for delays, extra costs, failed deliveries, tax issues, carrier issues, missed notices, or other problems caused by inaccurate, incomplete, outdated, or missing information supplied by Customer.

Site Readiness And Access

Customer is responsible for confirming that the delivery location, receiving location, and product location are ready, safe, accessible, and suitable.

Customer is responsible for measurements, doorways, hallways, stairs, elevators, loading docks, driveways, parking, floor protection, flooring capacity, wall/floor structure, building rules, certificates of insurance, permits, approvals, receiving hours, freight elevator reservations, union labor requirements, and any other site-specific requirements.

Customer is responsible for additional costs caused by inaccurate measurements, site limitations, denied access, missed appointments, failed delivery, refused delivery, delays, rescheduling, extra handling, storage, return trips, special equipment, building requirements, or site conditions.

Inspection Upon Delivery

Customer must inspect all packaging and products upon delivery.

Visible damage, missing items, suspected shortage, or damaged packaging must be noted on the carrier receipt, delivery paperwork, bill of lading, or proof of delivery before signing. Customer should photograph the packaging and product before unpacking when possible.

If a carrier asks Customer to sign for delivery, Customer should only sign after inspection and should clearly note any visible damage, missing items, crushed packaging, punctures, water damage, or suspected concealed damage on the delivery paperwork.

Concealed damage must be reported to Samuel Madeleine in writing within 48 hours after delivery, with photos, a description of the issue, and photos of all packaging. Customer must retain all packaging until the claim is resolved.

Failure to timely inspect, document, and report damage or shortage may limit or prevent a carrier, vendor, insurance, or warranty claim.

Failed Delivery, Refused Delivery, And Storage

If Customer is unavailable, the site is not ready, access is denied, delivery is refused, payment is outstanding, required information is missing, or Customer otherwise delays shipment, delivery, or release of goods, Customer is responsible for storage, demurrage, carrier fees, labor, insurance, rescheduling fees, return-trip fees, administrative costs, and related charges.

If goods remain unpaid, undeliverable, refused, delayed, or unclaimed for more than 60 days after written notice, Samuel Madeleine may, to the fullest extent permitted by law, treat the goods as abandoned, resell them, dispose of them, store them at Customer’s cost, or apply proceeds against amounts owed.

Nonrefundable Shipping And Related Charges

Unless required by applicable law or expressly agreed by Samuel Madeleine in writing, shipping, delivery, freight, white-glove delivery, return shipping, insurance, tariffs, duties, customs charges, brokerage fees, import fees, storage fees, and other non-product charges are not refundable.
